DISTRICT BOUNDARIES The text of the District descriptions and the map are intended to convey one and the same physical and geographical concept. In any instance of apparent discrepancy, both the written and pictorial descriptions are to be considered in the light of the stated purpose of the Ordinance. Boundaries of Districts are intended to fall on section boundaries, quarter section lines or property lines that can be readily discovered. Depths of Districts, where expressed in feet, are to be measured in the most practical manner possible, and shall be measured at right angles to the road, right-of-way, shoreline, etc., as applicable, it is not the intent of this Ordinance to work undue hardships in establishing Districts boundaries. General Exclusions Any of the foregoing descriptions to the contrary, no District described in this Ordinance includes any part of the Village of Bellaire, nor does any portion of the Ordinance apply to it. Clarification & Resolution of Disputes The Zoning Board of Appeals is empowered to clarify and further define, to any extent necessary, the District boundaries, and to settle any dispute as to the specific location of a boundary or the intent of the written or pictorial descriptions. AGRICULTURAL DISTRICTS - "A" General Description: Open fields and meadows mixed with forests forms the Agricultural land in Forest Home Township. Specific Description of "A" Boundaries All land within Forest Home Township not otherwise assigned to a specific District is assigned to Agricultural District - "A". RESIDENTIAL DISTRICT - General Description Land between the shoreline of a lake or river and the right-of-way of a more or less parallel county road or state road, and any non-shoreline land that warrants comparable treatment. Specific Description of "R-l" Boundaries Along the east shore of Torch Lake; all land lying between the shoreline
arid County Road 593, beginning at the north boundary of Forest Home
Township and running southward continuously to the north boundary (extended
to Torch Lake) of the right-of-way of that segment of County Road running
in an east-west direction, roughly parallel to Clam River which nuns
between County Road 593 and the shoreline of Torch Lake. 3. All land in Section 3 lying south of Clam Lake Road; and, all land in the east half of Section If and the west half of section 12 lying south of Cottage Drive. The west 837 feet of Section 2 lying within 500 feet of the shoreline of Clam Lake and all land in Section I 1 between this land and Clam Lake. 5. Along the westerly shore of Lake Bellaire; all land in Section 12 lying between the shoreline and the County Road known as Cottage Drive, except the south half of Government Lot No. 3 and, all land in Section 1 and 2 lying between the shoreline and Cottage Drive; and, all land in the south half of Section 35 lying between the shoreline and Cottage Drive; and, all land in the north half of Section 35 within 500 feet of the shoreline of Lake Bellaire. 6. In the north half of Section 26, all land between Briar Lane and the shore of the North Arm of Lake Bellaire, and all the plat of "Park-View Beach" and all land in the north half of Section 25 within 500 feet of Lake Bellaire. 7 Along the North Arm of Lake Bellaire in the SE 1/4 of Section 22, the high ground beginning 573 feet N, along Clam Lake Road from the South boundary and meandering southeasterly to a point 470 feet east of Sec 27 N. Line, 1/8th Corner on Clam Lake Road. Also in Section 27 the high ground beginning 470 feet East of 1/8th comer on Clam Lake Road (Easterly on Lake access road) meandering southerly 1,298 feet (survey 4-20-88, Lennox & Assoc., Job 88026) 8. Along Intermediate Lake; all land in Section 1, 2 and 3, lying between M-88 and the shoreline, and in Section 12, the north 250 feet lying between M-88 right-of-way and Intermediate Lake, that parcel of land described as the west 200 feet of the SE 114 of the SE 1/4 of Section 12 lying east of the former C&O Railroad, except the south 470 feet. 9. In Section 13, near its northeast corner, a lot known as No. 13 of Silver Pines Survey. RESIDENTIAL DISTRICTS - "R-2" General Description: Along principal county or state roads that more or less parallel a lake or river shoreline, the land on the opposite side of the road from the shoreline to a depth of 400 feet, and any other land along such road that warrants comparable treatment. Specific Description of "R-2" Boundaries 1. Along County Road 593 all land easterly of the right-of-way to a depth of 400 feet, beginning at the north boundary of the Township and running continuously southward to the right-of=way of Clam Lake Road, where it intersects County Road 593. 2. In Section 3 and 4. all land northerly of the right-of-way of Clam
Lake Road, to a depth of 400 feet. Near Lake Bellaire, In Sections 1 and 2, and in the south half of Section 35, all land west of Cottage Drive to a depth of 400 feet, except, in Section 2, a parcel beginning at a point 500 feet south of Steiner Road and 300 feet west of Cottage Drive thence southeasterly 400 feet parallel with Cottage Drive, thence west 100 feet, and northwesterly 400 feet to a point 100 feet west of the point of beginning. 5 Near Intermediate Lake, in Section 12 and the east half of Section
11, all land south of the east 6. Along County Road 620, the entire subdivision registered under
the name "Cedar Meadows. General Description: Land which can accommodate a cluster development
and still maintain the rural character of the landscape. I. All of land outside of the plat of Village of Bellaire and West on M-88 in Section 24. 2. The northwest 1/4 of Section 25 lying west of the plat of the Village of Bellaire and including the east ½ of the northwest 114 and the northwest 1/4 of the northwest 114. The west half of Section 24. WATERFRONT COMMERCIAL DISTRICTS – “WC” General Description: The land along Clam River from Torch Lake to the east end of Watomie Pines plat. Specific Description of "C" Boundaries 1. Along the entire length of Clam River, in Section 4, all land southerly of the County Road running east-west between County Road 593 and the shoreline of Torch Lake. 2. Along Clam Lake, in Section 4, all land southerly of Clam Lake Road. beginning at the entrance of Clam River and running continuously in a south-easterly direction to the east boundary of the recorded plat of Watomie Pines Subdivision. 3. The above definitions intending to provide a continuous Waterfront
Commercial District frontage along Clam River and Clam Lake, running
from Torch Lake to the east boundary of Watomie Pines Subdivision. General Description: The land along a lake or river which has a high water table or is partially or wholly submerged is a Wetland. Specific Description of "W" Boundaries 1. At the south end of Lake Bellaire and along Grass River, all land in the east half of Section 1 and in the east half of Section 12 east of Cottage Drive, except the north half of Gov't Lot No. 3 and all of Govt Lot No. 4, also excepting, in the Anmar Subdivision, Lots No. 8 through 13 inclusive. 2. Along Lake Bellaire and the North Arm, in Section 26, all land southerly and westerly of the shoreline, also the north 500 feet of Section 35, to a depth of 500 feet. 3. Along the North Arm of Lake Bellaire, in Section 27, all land westerly of the shoreline to a depth of 500 feet, except the 4-20-88 survey rezoning the high bank meandering southerly for approximately 1298 feet to R-l; and in Section 22, all land between the shoreline and County roads more or less parallel to the shoreline, (includes portions of Clam Lake Road and County Road 620) except the high ground beginning 573 feet north along Clam Lake Road from the south boundary and meandering southeast to Sec. 27, 4-20-88 survey beginning point on north boundary of Sec. 27 is now R-1. In Section 23, all land northerly and easterly of the shoreline to a depth of 500 feet, and of of the south half of Sec. 25, including the peninsula of land south of the south boundary of Sec. 25, in Govt Lot No. 4. 4. In Section 22, along Grass Creek, 700 feet to each side of Grass Creek, north of County Road 620 to the north boundary of Section 22, and in Section 15, 350 feet to each side of Grass Creek, and in Section 10, 350 feet to each side of Grass Creek, south of Honey Hollow Road. 5. In Section 19, all land between the former C&O Railroad right-of-way and the Intermediate River. 6. In Section 18, land to a depth of 500 feet west from the shorelines of Intermediate Lake and Intermediate River: 7 In Sections 7 and 12, all land between the M-88 right-of-way and Intermediate Lake, except that parcel of land described as the west 200 feet of the SE 114 of the SE 1/4 of Section 12 lying east of the railroad, except the, south 470 feet, and also except the north 250 feet of Section 12 between the M-88 right-of-way and Intermediate Lake. 8. In Section 11, all land along Clam Lake to a depth of 500 feet, from the north boundary of Section 11 to the north-south quarter line of Section 11. MANUFACTURING PARK DISTRICT "M" General Description: No area has been zoned as a Manufacturing Park
