ARTICLE 29 - BOARD OF APPEALS

Section 29-100 PURPOSE - The purpose of the Board of Appeals is to allow any person aggrieved or any officer, department, board, or bureau of the township, county or state an appeal to a decision made by the Planning Commission and/or Zoning Administrator.

Section 29-200 MEMBERSHIP - The Board of Appeals shall consist of five (5) members.
Section 29-201 The first member shall be a member of the Planning Commission.

Section 29-202 The remaining members of the Board of Appeals shall be selected from the electors of the township residing outside of the Village of Bellaire.

Section 29-203 The members selected shall be representative of the population distribution and of various interests present in the township.

Section 29-204 One member may be a member of the Township Board.

Section 29-205 An elected officer of the township shall not serve as Chair of the Board of Appeals.

Section 29-206 An employee or contractor of the Township Board may not serve as a member or an employee of the Board of Appeals.

Section 29-300 TERM

Section 29-301 The term shall be for three (3) years. If members are serving on the Planning Commission or Township Board, their terms shall be equal to their terms on the Planning Commission or Township Board or for three years, whichever is less.

Section 29-302 Appointments to fill a vacancy in a term shall be for the balance of the term. The term of membership shall be stated in the resolution of appointment.

Section 29-303 All members of the Board of Appeals shall be appointed by the Township Board.
