Section 28-400 PLANNING COMMISSION: RESPONSIBILITIES Section 28-401 Before taking any action or making any recommendation on a map or text amendment, the Planning Commission shall hold a minimum of one public hearing. Section 28-402 When an application for an Ordinance amendment filed in proper form and with the required data, the Secretary shall immediately place the application upon the calendar for hearing and cause notices stating the time, place, and object of the hearing to be served. Section 28-403 Notice of the hearing shall be by two (2) publications
in a newspaper that circulates in the Township, the first to be
published not more than thirty (30) days nor less than twenty (20)
days and the second not more than eight (8) days before the date
of the hearing. Section 28-405 Such notices shall be served personally or by regular mail, addressed to the respective owners and tenants at the address given in the last assessment roll. If the name of the occupant is unknown, the term "Occupant" may be used in making notification. Section 28-406 Any party may appear at such hearings in person or by agent or by attorney. Section 28-407 A notice shall be mailed by first class mail to all utilities operating or having business interests within the township no less than twenty days prior to the public hearing provided said utility registers its name and mailing address with the Planning Commission for the purpose of receiving such notice. Section 28-408 An affidavit of mailing shall be retained on file with the application for text or map amendment. Section 28-409 All notices shall contain a summary or complete text or effect of the proposed change, the time, date, and location of the Public Hearing. Section 28-410 In addition, the notice shall state the times and locations where the proposed changes as well as currently existing Ordinance can be examined or purchased. Section 28-411 Following such hearing, the Planning Commission shall submit the proposed amendment or supplement, a summary of the comments received as well as the recommendation of the Planning Commission and the rationale supporting it recommendation to the Township Board and to the Antrim County Planning Commission for its review. Section 28-412 The County Planning Commission may recommend approval, approval with modifications or denial of the proposed amendment(s). Section 28-413 The Antrim County Planning Commission shall have thirty days or such additional time as may be allowed by the Township to review and provide comments back to the Township. Section 28-414 After the Township Board has received the recommendation of the Planning Commission and the Antrim County Planning Commission or after 30 days has passed since the Planning Commission submitted their recommendation to the County Planning Commission, the Township Board may take action. Section 28-415 The Township Board may hold a public hearing if
it so desires or shall hold a public hearing if requested by certified
mail by a property owner. Section 28-418 Should the Township Board elect to consider changes
to the text or map amendment as recommended by the Planning Commission,
it shall refer the changes to the Planning Commission and request
a report to be submitted back to the Township Board within a specified
time period. Section 28-420 Within fifteen 15 days after adoption by the Township
Board, the Township Board shall publish the amendment or a summary
of the regulatory effect of the amendment along with an effective
date of the amendment. Section 28-420The publication shall contain the location and hours
at which the Ordinance can be reviewed or purchased.
