ARTICLE 27 - ADMINISTRATION, ENFORCEMENT AND PENALTIES Section 27-100 PURPOSE

Section 27-200 ZONING ADMINISTRATION

Section 27-201 The provisions of this Ordinance shall be administered and enforced by a Zoning Administrator, appointed by the Township Board for such term and subject to such conditions and at such rate of compensation as said Board shall determine as reasonable. For the purpose of this Ordinance, the Administrator shall have the power of a police Officer.

Section 27-300 ZONING PERMIT

Section 27-301 Requirement of a Zoning Permit. No building or structure or activity subject to the provisions of this Ordinance shall hereafter be erected, altered, reconstructed, used, undertaken or removed on any premises until application for a Zoning Permit has been filed with the Township Zoning Administrator on forms provided by the Township, and the Zoning Administrator has issued such a Permit. No permit application shall be accepted for any use or activity requiring a zoning permit until such time as the applicant is able to provide evidence of a valid sanitary waste disposal system permit or is able to demonstrate the ability to connect to a municipal sewage disposal system.

Section 27-302 Display of Zoning Permit. This permit shall be displayed by the owner or his agent in a prominent position on the location of said construction, remodeling, moving, etc.

Section 27-303 Information Supplied. The application shall be signed by the owner of the premises or his agent and shall certify that all provisions of this Ordinance and other applicable laws and requirements are to be complied with. The application shall be filed not less than ten (10) working days prior to the intended initiation of any work on the premises and shall be accompanied by:

1. A sketch, or sketches, showing the location and dimensions of the premises, including the boundary lines of all parcels of land under separate ownership contained therein; the size, dimensions, location on the premises, and height of all buildings of structures to be erected or altered; and the location of all wells and sanitary waste disposal systems to be utilized. The Zoning Administrator is granted the discretion to require a survey of the property should the Administrator believe it necessary to verify the information furnished by the applicant.

2. Such approvals of other agencies as may be required by this Ordinance including but not limited to a sanitary waste disposal system and well permits from the Northwest Michigan Community Health Agency.

3. Such other information as may be required to determine compliance with the Ordinance.

4. The applicant shall physically stake the location of proposed building and property lines at the request of the Zoning Administrator.

Section 27-304 Issuance of a Zoning Permit. Whenever the information supplied in above is determined to be in conformity with the provisions of this Ordinance, the Zoning Administrator shall issue the owner a Permit within ten (10) days of such determination. In any case, where a Permit is refused, the cause shall be stated in writing to the applicant. A zoning permit is not automatically transferable. A permit to be transferred shall be reviewed by the Township Zoning Administrator with the proposed recipient to insure a clear understanding of the requirements of the permit.

Section 27-305 Expiration. Any -Zoning Permit under which no substantive work has been undertaken within twelve (12) months from the date of issuance shall expire by limitation but shall be renewable upon reapplication and payment of appropriate fees as determined by the Township and subject to the provision of all Ordinances in effect at the time of renewal.

Section 27-306 Revocation. The Zoning Administrator shall have the power to revoke or cancel any Zoning Permit in case of failure or neglect to comply with the provisions of this Ordinance, or in case of false statement or misrepresentation made in the application. The owner or applicant shall be notified of such revocation in writing as shall the Antrim County Building Inspector.
