Section 19-700 PERFORMANCE GUARANTEE

Section 19-701 The Planning Commission may require a performance guarantee by the applicant to ensure completion of improvements associated with the application for Special Approval.

Section 19-702 Improvements mean those features and actions associated with an application which are considered necessary by the Planning Commission to protect natural resources, or the health, safety and welfare of the residents of the township and future users or inhabitants of the proposal which is the subject of the application, including roadways, lighting, utilities, sidewalks, screening, and drainage.

Section 19-703 Improvements do not include the entire project which is the subject of the application.

Section 19-704 The performance guarantee shall be determined by the Planning Commission and shall be reasonably related to the cost of improvements per acre of land effected by the application.

Section 19-705 The performance guarantee shall be deposited with the Township Treasurer prior to any permit issuance.

Section 19-706 The performance guarantee shall be proportionally rebated by a rate equal to the percentage of completion.

Section 19-707 The Zoning Administrator shall be responsible for monitoring performances and shall notify the Township Treasurer when amounts are to be rebated.
