ARTICLE 18 - NON-CONFORMING LOTS. USES. STRUCTURES & SIGNS

Section 18-100 PURPOSE

Section 18-101 The purpose of this Article is to describe how non-conforming uses and structures will either be eliminated or changed to conforming uses and structures over time. This Article is intended to encourage the elimination of non-conforming uses and structures.

Section 18-102 Non-conforming uses and structures are those which do not conform to a provision or requirement of this Ordinance or any subsequent amendment but which were lawfully established prior to the time of Ordinance adoption or amendment.

Section 18-103 All non-conforming uses/structures shall be classified as Class B until such time as they are re-classified as Class A non-conforming or fully conforming by the Planning Commission.

Section 18-104 Class A non-conforming uses or structures are those which have been so designated by the Planning Commission, upon finding that the use or any portion of the structure:

1. Is not in an environmentally sensitive area;

2. Is not contrary to the purpose of this Ordinance as described above (and Article 1)

3. Is not likely to significantly depress the value of nearby properties;

4. Was lawful at the time of its inception and that no useful purpose would be served by strict application of the provisions or requirements of this Ordinance with which the use or structure does not conform;

5. Is of economic benefit to the community.
