Section 10-400 REQUIREMENTS

Section 10-401 Density Regulations - No land shall hereafter be used in this zone district unless the following density regulations are followed and maintained.

1. Not more than four (4) dwelling units per gross acre or 1 per thirty-five feet (35') of water frontage shall be permitted in this zone district, except as otherwise provided.

2. There shall be a minimum of forty percent (40%) of the gross area of each parcel in the "R-3" District maintained as open space or nonprofit recreational uses.

3. An increase in density shall be allowed provided the following percentages of land area remain as open space:

4. One additional dwelling unit per acre shall be allowed provided a nonmotorized recreational trail is developed within the property for use by the general public with the trail connected to, or capable of being connected to trails created in the future on adjacent properties.

5. In order to determine the net acreage in a particular "R-3" project, the developer shall deduct the following acreage from the gross acreage:

a. Lands having a slope greater than eighteen percent (18%) (eighteen feet of
vertical 601 per one hundred (100) lineal feet).
b. Lands having a ground water table four feet (4') or less from the surface. c. Lands covered by water.
d. Lands currently being utilized as a utility right-of-way, or dedicated as some other type of right-of-way.

Section 10-402 Setbacks
1. Development Project Setbacks a. Public Street Setbacks

1. Developments consisting entirely of single family dwellings or duplexes shall maintain a minimum of a fifty (50) foot landscaped setback from any public street that borders the property boundaries

2. All developments in this district containing multiple family dwellings shall maintain a minimum of a one hundred (100) foot landscaped setback from any public street that borders the property boundaries

b. All other property boundary line setbacks

1. A minimum of a fifty (50) foot landscaped setback from all property lines which do not front upon a public street shall be maintained.

2. A buffer zone at least twenty feet (20') in width containing suitable screening consisting of trees and shrubs shall be established and maintained between building envelopes and public roads or non-forested open spaces.

a. Individual Lots

b. Condominium Site Condominium Units created under provisions of this District shall be situated in such a manner that the borders of building envelopes shall be located a minimum of forty feet (40') from the borders of all other building envelopes.

2. All principal and accessory structures (e.g. garages, storage sheds, etc) shall be located entirely within the building envelope.

3. Building envelopes shall be situated to meet the following standards. They are listed below in order of priority. It is recognized that some situations may not exist or may conflict with others on any given site

a. On soils not considered "hydric" by the USDA Soil Conservation Service;

b. In order to provide summer shade and shelter from winter wind, and to enable new construction to be visually absorbed by natural landscape features, building envelopes shall be located within the marginal edges of any woodlands where woodlands comprise fifty (50) percent or less of the parent parcels area or in any location in woodlands where woodlands comprise more than fifty (50% percent of the parent parcels area. A maximum of fifty (50%) percent of said marginal edges may be used for such purposes. Marginal

edges shall extend a maximum of two hundred feet (200') into the interior of said woodlands);
c. On areas not designated as of prime agricultural or forest soils. In situations where it is necessary to locate building envelopes on said soils, it shall be done in such a manner which shall maximize the usable area remaining for agricultural and/or forestry uses;
d In locations least likely to block or interrupt scenic vistas. as seen from the public roadway(s) and waters; Note. (In such situations where it is necessary to locate building envelopes in such areas, the Planning Commission may require landscape plantings be established and maintained to screen and otherwise minimize the visual impact of buildings)
e Building Envelopes shall not be located in areas where the natural pre-existing slopes are (or were) greater than eighteen (18%) percent.
f. In situations where it is necessary for lots or site condominium units or building envelopes located on said lots or site condominium units to access directly onto an existing public road rather than onto a private road, the minimum frontage requirement for the lots or site condominium units on the public road shall be three hundred and fifty feet (350'). (Note -1~ or purposes of this provision no building envelope, lot or site condominium shall be considered as being serviced by more than one (1) private road) See Article 19
Section 10-403 Height Regulations - No single family dwelling or duplex shall exceed thirty-five feet (35) in height. No building containing multiple family dwellings shall exceed forty feet (40') or three (3) stories in height, whichever is less.
Section 10-404 Floor Area Regulations - If the developer proposes a mixture of units having differing floor plans, an average floor area of seven hundred fifty (750) square feet shall be maintained. In no instance shall any dwelling unit in this district have a floor area of less than four hundred and eighty feet (480') of usable floor area exclusive of porches, patios, garages, basements and utility areas. All dwellings must have a storage area available either in closet space, basement, or attic equal to or greater than ten (10) percent of the floor area
Section 10-405 Other Development Regulations
1. The horizontal distance measured in feet between parallel or nearly parallel elements of buildings forming courts and courtyards shall be not less than the height of the taller building.
2. Not less than two (2) off street parking spaces shall be required for each dwelling unit. Such parking shall be placed so as not to interfere with any recreation or service area and shall not be less than twenty-five (25') from any property lines or street right-of-way lines. See Article 3.

Alt areas provided for use by vehicles shall be surfaced with bituminous asphalt, concrete or materials, specifically designed for parking upon, including paver block, grasscrete, but excluding gravel, dirt, or sand.

Areas for loading and unloading delivery trucks and other vehicles and for refuse collection service, fuel, and other services shall be provided and shall be adequate in size and be arranged that they may be used without blockage or interference with the use of access ways or parking areas.

5 Provisions shall be made for safe and efficient ingress and egress to the public streets and highways servicing the "R-3" Zoning District without undue congestion or interference with normal traffic flow

6. All buildings within this zoning district shall be served by a community sewage disposal system and an approved potable water supply. The sewage disposal system shall be approved by the Michigan Department of Environmental Quality and the Northwest Michigan Community Health Agency

7. All utility lines (power, telephone, water, gas, cable TV) serving the "R-3" Zoning District shall be placed underground,

8. The developer shall be required, to preserve or incorporate natural features such as woods, streams and open spaces which add to the overall development of the area.

9. The developer shall make provisions for community areas, laundry facilities, playground and tot lots, and other services necessary for the comfort and convenience of "R-3" residents.

10. A development plan shall be submitted for each multiple family development or other permitted use in the "R-3" Zoning District in accordance with Article 15, Site Plan Review, of this Ordinance, and said plan shall indicate or illustrate how the requirements of this section are being met.
