Section 5-200 AREA AFFECTED

Section 5-201 The requirements of this section supplement those imposed on the same lands by any underlying zoning provision of this ordinance or any other ordinance of Forest Home Township. These regulations supersede all conflicting regulations in the underlying zoning districts to the extent of such a conflict and no further.

Section 5-300 WETLANDS OVERLAY DISTRICT MAP

Section 5-301 The Forest Home Township Wetlands Overlay District Map, as updated from time to time, delineates the general location of wetlands which may be subject to regulation under this Article. This is a non jurisdictional map and actual delineation of wetland boundaries on individual parcels or sites shall be the responsibility of persons applying for a wetland use permit.

Section 5-302 Final authority regarding wetland boundaries lies with the Forest Home Township Planning Commission. (Note; Section 30308 (1) of the Natural Resources and Environmental Protection, P.A. 451 of 1994, as amended, states that the Wetlands Overlay District Map may not necessarily include all wetlands that may be subject to regulation.)

Section 5-303 Whether property is a wetland, and the exact location of wetland boundaries, must be determined on a case by case basis. The inclusion of property in the Township Wetlands Overlay District Map does not create any legally enforceable presumption regarding whether that property is or is not in fact a wetlands.)
