Section 5-1001 In addition to the enforcement remedies permitted by this ordinance or by law, a court may order a violator of this Article to restore as nearly as possible the wetland which was affected by the violation to its original condition immediately before the violation. The restoration may include the removal of fill material deposited in the wetland or the replacement of soil, sand, or minerals as well as the restoration of wetland hydrology to its original state, and the re-vegetation of the site with native plants similar to those on the site prior to the violation. Section 5-1100 TAX ASSESSMENT REVALUATION Section 5-1101 If a landowner is denied a permit for a proposed wetland use, a landowner may appear at the annual Board of Review for the purpose of seeking a revaluation of the affected property for assessment purposes to determine its fair market value under the use restrictions. (Note: This section is mandated by Section 30310 (1) of the Natural Resources and Environmental Protection Act, P.A. 451 of 1994.) Section 5-1200 EXPIRATION OR REVOCATION Section 5-1201 Failure to complete the permitted activity in conformance
with the approved application and conditions within one (1) year from
the date of approval shall cause the loss of the special approval.
A wetlands permit may be revoked for the same reasons and in the same
manner as provided in Article 14.
