Section 3-800 SOIL, SAND OR OTHER MATERIALS: REMOVAL

Section 3-801 The removal of soil, sand, topsoil or other material from the land for commercial purposes requires Special Approval from the Township.

Section 3-802 If the activity is within five hundred feet (500') of a water body or if the activity disturbs one or more acres of land a soil erosion permit may be required from the Antrim County Soil Erosion and Sedimentation Control Officer.

Section 3-803 The application must be accompanied by a suitable agreement or bond that such removal will not cause stagnant water to collect, or that no material shall be taken from any part of a lot within one hundred (100') feet of any road or trail traveled by the general public, or within one hundred (100') feet of an adjacent lot line, or leave the surface of the land, at the expiration of such permit, in an unstable condition or unfit for the growing of turf or for other land uses permitted in the zone in which such removal occurs.

Section 3-804 The provisions of this section shall not be construed to prohibit normal excavation or grading incidental to the construction or alteration of buildings.

Section 3-805 The applicant must meet the appropriate requirements of the Antrim County Soil Erosion and Sedimentation Runoff Control Ordinance and all other state and federal regulations.

Section 3-900 UNSAFE BUILDINGS: RESTORATION

Section 3-901 Nothing in this Ordinance shall prevent the strengthening or restoring to a safe condition any part of any building or structure declared unsafe by the Antrim County Building Department.
