Section 3-1900 JUNKYARDS OR SALVAGE YARDS

Section 3-1901 The owner of a junkyard must be licensed by the State of Michigan - Secretary of State's office.

Section 3-1902 Special Approval may be issued by the Planning Commission upon a determination that all provisions of this section are, or will be complied with.

Section 3-1903 In deciding whether to grant special approval, or Special Approval With Conditions, the Planning Commission shall consider the requirements of this section as well as the factors of Article 19.

Section 3-1904 The operator of any junkyard or salvage yard for which special approval is granted, shall, as a condition of such approval, agree and be subject to, periodic on-site inspections by the Zoning Administrator to ensure continuing compliance with this section and any special conditions of the Special Approval. Inspections will take place during working hours.

Section 3-1905 The maximum site area allowed for a Junkyard or Salvage yard shall be five (5) acres.

Section 3-1906 No junkyard or salvage yard shall be permitted within one thousand feet (1,000) of any Residential Zone.

Section 3-1907 The salvage yard or junkyard shall have a wall, fence or screen around the entire periphery of the property in use unless naturally shielded by woods or hills of such nature that material located on the property cannot be seen from neighboring land and roads.

Section 3-1908 Walls, fences, or screens shall meet these requirements:

1. Be of a uniform height in relation to the ground upon which they stand and shall be a minimum height of eight feet (8'}.

2. Be constructed at least five feet (5') inside the front, side, and rear lot lines, provided however; the wall, fence, or screen shall not be erected within a public road right-of-way and if located at a highway intersection, shall comply with Article 3, Clear Vision Zone.

3. Be constructed solely of new materials unless the Zoning Administrator approves the substitution of used materials where such used materials will provide the equivalent service, appearance and useful life.

4. All walls, fences, or screens shall be painted or stained in a uniform, neutral color which blends with the surrounding terrain and structures.

5. Be maintained in a manner commensurate with the original site plan and drawings, if any, and as originally erected.

6. Junk or salvaged materials shall not be piled higher than the height of the wall, fence, or screen.

7. All activities associated with the salvage yard or junkyard shall be confined within the enclosed area of the wall, fence or screen. No equipment or material associated with the junkyard or salvage yard shall be used, displayed or stored outside the wall, fence, or screen.

8. A wall, fence, or screen may consist of natural or planted vegetation, or vegetated earthen embankments protected to minimize erosion, subject to the approval of the Zoning Administrator.

Section 3-1909 Burning of junk on site is not allowed.

Section 3-1910 No signs, posters or other advertising mechanisms shall be placed on land, walls, fences, structures or screens associated with the junkyard of salvage yard.

Section 3-1911 The draining, storage, or disposition of oil, gasoline, hydraulics or other fluids which are regulated by the State of Michigan shall be in compliance with the laws of this state. Drainage of fluids from vehicles must be performed on an impervious surface and drain to a sealed collection system with a backup containment system.

Section 3-1912 Intensity level of sounds generated by the operation of a junkyard or salvage yard shall not exceed 60 decibels when measured at the property line of the residential use which is closest to the junkyard or salvage yard between the hours of 8 a.m. to 5 p.m daily.
