Section 2-2100 "T"

Section 2-2101 Tavern. An establishment serving alcoholic beverages in which the principle business is the sale of such beverages at retail for consumption on the premises and where food may be available for consumption on the premises.
Section 2-2102 Telecommunications Adequate Coverage. Coverage is considered to be "adequate" within that area surrounding a base station where the predicted or measured median field strength of the transmittal signal is greater than -95dbm. It is acceptable for there to be holes within the area of adequate coverage where the signal is less than -95dbm, as long as the signal regains its strength to greater than -95dbm further away from the base station. For the limited purpose of determining whether the use of a repeater is necessary or desirable, there shall be deemed not to be adequate coverage within said holes. The outer boundary of the area of adequate coverage, however, is that location past which the signal does not regain a strength of greater than -95dbm.

Section 2-2103 Telecommunications Adequate Capacity. Capacity is considered to be adequate if the grade of service is p.05 or better for at least 50% of the days in a preceding month, prior to the date of application, as measured using direct traffic measurement of the personal wireless facility in question, where the call blocking is due to frequency contention at the antenna(s).

Section 2-2104 Telecommunications Monitoring Protocol. The testing protocol, initially the Cobbs Protocol, which is to be used to monitor the emissions from existing and new personal wireless service facilities upon adoption of this Ordinance. As the technology changes, the Planning Commission may write regulations which require the use of other testing protocols. A copy of the monitoring protocol shall be kept on file with the Zoning Administrator.

Section 2-2105 Telecommunications Repeater. A small receiver/relay transmitter of not more than 20 watts output designed to provide service to areas which are not able to receive adequate coverage directly from the base stations, which are located on existing towers and which do not require the construction of new towers.

Section 2-2106 Telecommunication Towers and Facilities or Tower. All structures and accessory facilities, including Alternative Tower Structures, relating to the use of the radio frequency spectrum for the purpose of transmitting or receiving radio signals; including, but not limited to, radio towers, television towers, telephone devices and exchanges, microwave relay facilities, telephone transmission equipment buildings, private and commercial mobile radio service facilities, personal communication services towers (PCS), and cellular telephone towers. Not included in this definition are: citizen band radio facilities; short wave receiving facilities; radio and television broadcast reception facilities; satellite dishes; federally licensed amateur (HAM) radio facilities: and governmental facilities which are subject to state or federal law or regulations which preempt municipal regulatory authority.

Section 2-2107 Tent. Any temporary arrangement of flexible materials and a supporting frame for recreational living quarters, and designed for quick erection and removal. For purposes of this Ordinance, children's play tents not used for sleeping purposes are excluded from this definition.

Section 2-2108 Transfer of Ownership or Control. Includes: the sale, lease or sublease of a business; controlling interest in the business, whether by sale, exchange or similar means; the establishment of a trust, gift, or other similar legal device which transfers the ownership or control of the business, except for transfer by bequest or other operation of law upon death of the person possessing the ownership or control.

Section 2-2301 Vehicle. A device or structure for transporting persons or things; a conveyance.

Section 2-2400 "W"

Section 2-2401 Wetland. Land characterized by the presence of water at a frequency and duration sufficient to support, and that under normal circumstances supports, wetland vegetation or aquatic life, fosters the development of hydric soils, and is commonly referred to as a bog, swamp, or marsh.

Section 2-2402 Wetland Vegetation. Macrophytic plant life that occurs in areas where the frequency and duration of inundation or saturation produces permanently or periodically saturated conditions of sufficient duration to exert a controlling influence on the plant species present.
